What are the New Dog Control Orders?

Dog Control Orders.

  

The Dog Control Order (DCO) (which is implemented under the new powers in the Clean Neighbourhoods and Environment Act 2005) replaces the Manchester City Council Dogs (Fouling of Land ) Order 2001 and enables controls in relation to

  • A. fouling of land by dogs and the removal of dog faeces.
  • B. the keeping of dogs on leads.
  • C. the putting, and keeping, of dogs on leads when directed to do so by an authorised officer
  • D. the exclusion of dogs from land.
  • E. the number of dogs which a person may take on to any land.

The following powers are now granted:

A. Failing to remove dog faeces

Owners will be required to pick up faeces deposited by their dog at all times. This will apply to the whole of the city of Manchester. (See Note 1).

B. Not keeping a dog on a lead

The new offence requires dog owners to ensure their dogs are kept on leads in designated areas. In Manchester this will apply to all roads, pavements and footpaths, including gated alleyways, small parks, planted flower beds and horticultural centres.

C. Not putting and keeping a dog on a lead when directed to do so

This will require a dog owner to put their dog on a lead when directed to do so by an authorised officer of the Council. It will apply to the whole of the city of Manchester.

D. Permitting a dog to enter land used for play and sports

Manchester will control dogs and dog fouling by excluding dogs from play areas in parks and from land used for sports as well as cemeteries and crematoria. (See Note 1)
 

E. Maximum number of dogs controlled at a given time

Owners will be permitted to take a maximum of 4 dogs in to parks or on to land used for recreational purposes. Manchester agree that this is a reasonable number and believe that the person responsible for the dogs would find it difficult to control more than four dogs at any one time.

The Penalty

The penalty in relation to any offence in any dog control order is, on summary conviction, a fine not exceeding level 3 on the standard scale (£1,000 at 14.03.2007).
A person may be offered the opportunity to discharge any liability to conviction for any offence under any dog control order by payment of a fixed penalty. The specified amount of the fixed penalty is £80 if paid within fourteen days (or £50 if paid within ten days).

Note 1. This offence does not apply to registered blind persons or to persons who rely on an assistance dog trained by Dogs for the Disabled, support dogs or Canine Partners for Independence with a disability affecting mobility, manual dexterity, physical coordination or ability to lift, carry or otherwise move everyday objects.

                 
          Do I have to clean up after my dog?
 
Owners will be required to pick up faeces deposited by their dog at all times. This will apply to the whole of the city of Manchester. (See Note 1).

Manchester City Council collects on average 500 tonnes of Dog waste each year from the open spaces and streets. This equates to approximately 8000 instances of dog fouling every day throughout Manchester! No-one likes dog mess, and responsible dog owners agree that we all need to do our bit to reduce the problem.

In order to tackle this, Manchester City Council are encouraging all Dog Owners to act in a responsible manner when taking a Dog out for exercise, by immediately picking up the dog faeces after their pet.

For your convenience, Manchester's parks have Dog-Foul Bins placed in and around the parks, making it easy for you to dispose of the dog waste.

If you use a small bag, available from most supermarkets, you can collect the dog faeces and dispose of it in a nearby dog-foul bin. By doing this, you are supporting your local neighbourhood & community in keeping the streets and open clean and tidy.

Manchester City council is responsible for keeping the streets and public open spaces clean, which means that any mess not cleared by dog owners becomes a cost to the community.

      Do I have to keep my dog on a lead?
 
The new offence requires dog owners to ensure their dogs are kept on leads in designated areas. In Manchester this will apply to all roads, pavements and footpaths, including gated alleyways, small parks, planted flower beds and horticultural centres.

List of small parks and ornamental gardens to which this applies

This list of parks relates to 14 parks in total. Of this 14, there are 9 small parks and ornamental gardens where a dog will be required to be kept on a lead at all times. Within 5-10 minutes walking distance of all 9 areas there is a sizeable park where you will be able to exercise your dog off the lead. A further 6 parks have specific areas where dogs must be kept on a lead. Again, these refer to areas such as formal gardens and boating areas.

This new order will also mean that as a Dog Owner, you will not be able to allow your dog within any sports and activities area. You will still be able to walk and exercise your dog in other areas of the park.

This Order will ensure that the sports areas, children's play areas and football pitches can be used by visitors without concern that a Dog may foul on the pitch, or behave in an uncontrollable fashion.

Cemeteries and Crematoria

Cemeteries and Crematoria already have Byelaws in existence meaning that Visitors are not permitted to take their dogs into these areas.

Visting a Cemetery or Crematorium is a distressing time for many people, and we remain concerned that a minority of dog owners continue to take their dogs into crematoria and cemeteries, which causes considerable anguish to other visitors. Where the dog has fouled, or created a disturbance, this has further exacerbated a delicate situation.

We do recognise that it is very important for Animals to be sufficiently exercised, and support Responsible Dog Owners in promoting healthy lifestyles. Many Dog Owners exercise their pets, not only to help their dog to remain healthy, but to meet other people, and exercise themselves.

Manchester city Council fully supports this, and in the majority of parks throughout Manchester, many areas continue to be available for you to exercise your pets on and off the lead.

Don't Forget, you will need to keep your dog on a lead on paths, roads, pavements and canal tow paths. This is to make sure that neither you nor your pet become involved in any difficulties.
This will also make sure that dogs don't run unexpectedly into a road, causing traffic accidents, and also injuring your pet.

Free Poop Scoops

Dog Mess that is not cleaned up is unpleasant, and can be a health risk.  To ensure that you help keep your neighbourhood in a clean and healthy state, it is important to make sure that you clean up after your dog. 

Manchester residents can obtain poop scoops free of charge by contacting the Dog Warden team direct. If you provide your name and address details, one will be delivered to your address.

Manchester City Council can only make this offer available to households within the Manchester Wards.
